What is a motion for summary judgment?

A summary judgement is a written request for judgment on one party’s behalf. All pertinent information supporting the moving party’s claims will be entered into the judgment. The party making the summary judgment has the initial burden of showing the absence of a disputable material facts.

Summary Judgments are only granted when there is no genuine issue pertaining to material facts. The court’s denial of a motion for summary is not a final order and cannot be appealed.
